The Privacy Policy provided by Mozaik Inc., including its subsidiaries and affiliates (collectively, “we,” “our,” “us” or “Mozaik”), is based on our respect for the privacy of you (individually and collectively as “User(s),” “you” or “your”). We are committed to the responsible handling and protection of your personal information.

This Privacy Policy governs the manner in which we collect, use, maintain, and disclose information collected from Users of the Mozaik App, our Website, or any of our Services (each as defined below) and such Users’ online interactions through the Services.

This Privacy Policy does not apply to any third-party websites or social media platforms, which may provide information or offer products and services that Mozaik makes available through the Services.

To understand how any third party (including Apple and Google) treats your information, you should contact such third party or read its privacy policy and any other applicable terms and conditions.

By visiting our website currently located at www.mozaikapp.com (“Website”), downloading and registering to use our mobile app (“Mozaik App”), providing “Personal Information” (as defined below) to us, or accessing or using any other information, materials, or content (“Content”) or other services we provide in connection with or related to our Website or Mozaik App (“Other Services”), you have agreed to be subject to this Privacy Policy, as well as our Terms of Service.

The term “Services” individually and collectively refers to our Mozaik App, Website, Other Services, Technology, Other Applications, and any other Mozaik online websites and social media platforms, such as our Facebook and Instagram pages.

All capitalized terms not defined in this Privacy Policy are defined in the Terms of Service.

Age Requirement

• You may access or use our Services ONLY IF you comply with our Terms of Service and ONLY IF you are 13 years of age or older or any higher minimum age under applicable laws that govern the geographic location in which you reside.
• Do not use any of our Services if you are unwilling OR NOT ELIGIBLE to accept the terms and conditions of this Privacy Policy.

1. How You Are Subject to This Privacy Policy

• By using our Services, submitting information to us, or purchasing any of our other products or services, you consent to being governed by this Privacy Policy, and you consent to the collection, storage, use, and disclosure of such information in accordance with this Privacy Policy.

2. Personal Information We Collect

• We consider “Personal Information” to be information that identifies an individual (like a name, phone number, or email address) or that relates to an identifiable individual (like an IP address).
• Mozaik collects, uses, and stores your Personal Information when you:
  • Register to become a User.
  • Receive our newsletters after registering.
  • Participate in interactive features of the Mozaik App (e.g., answering a survey or providing feedback).
  • Request customer support.
  • Communicate with us through “Other Third-Party Resources” (as defined below).
  • Purchase or use other Mozaik products or services.
  • Otherwise communicate with us.

Registration

• When you download the Mozaik App, you will be required to create an account in order to gain access to the Services available through the Mozaik App, as further described in our Terms of Service.
• We will need to collect certain required Personal Information when you register for an account.
• We will then ask you to create a profile by providing other Personal Information, all of which is optional for you to provide.

Required Personal Information

• We will need to collect from you, when registering to be a “User” of the Mozaik App, the following Personal Information:
  • Email address
  • Date of birth
  • Username and password
• You may choose to log in with one of your social media accounts (e.g., Facebook, Google, Apple). In such cases, we will collect the following Personal Information:
  • Username
  • Date of birth
  • Email address
• Note: If we collect your username and password, Mozaik will not see or have access to your password because it will be encrypted.

Mozaik App Users - Profile Settings (Optional Personal Information)

• Photo
• Bio
• Movie genre interests (e.g., sci-fi, action, comedy, drama, horror)
• Gender you can portray as an actor in Mozaik Movies (e.g., male, female, neutral)
• Shot locations (e.g., home, yard, forest, mall, café)
• Age range you can portray as an actor in Mozaik Movies (e.g., 13-17, 17-24, 23-29)
• Links to external websites or social media accounts that feature you

Device Settings (Optional Personal Information)

• You may adjust your device settings to provide us with the following Personal Information:
  • Your location if you allow the Mozaik App to use geotagging
  • Your contacts if you allow the Mozaik App to access them through your address book or social media platform accounts
  • Your device information (e.g., unique device identifier) if you allow the Mozaik App to track your device

User-Generated Content (Optional Personal Information)

• As a Director, Actor, or Fan (all as described in our Terms of Service), you will be providing some or all of the following Personal Information (and content) while using the Mozaik App:
  • Videos, photos, images, text, comments, votes, shares, interactions with other Users, notes, messages, voice notes, creations of Mozaik Movies, Mozaik Twists, and Mozaik Clones
  • Your use of or access to Mozaik Movies, Popcoins, Mozaik Movie Tickets, Scripts, information for surveys, events, or contests, and other content and information related to your use of and communications with us about the Services

Usage Data

• Usage data or information generated through your use of the Mozaik App may include activities such as:
  • Mozaik Movies you viewed
  • Mozaik Movies you signed up to be cast in
  • Mozaik Movies that you have “Twisted” or “Cloned”
  • Movie Tickets purchased through the Mozaik App
  • Virtual gifts purchased or given to another User
  • Details of your activities as a Fan, Director, or Actor
• We process such usage data to help evaluate and improve our Services and other related business operations.
• We do not use your usage data for identification purposes but may use it as anonymous or aggregated information (as further described below).

Third-Party Sources

• We may collect Personal Information from “Other Third-Party Sources,” such as social media networks, public information sources, and third-party partners that offer co-branded services or products through Mozaik.
• If you create or log into your account through a social media service, we may have access to certain information from that account (e.g., name, profile, email, contact list), in accordance with the authorization procedures set by that social media service.
• We may also obtain information about you from publicly available sources, marketing and advertising partners, consumer research platforms, and/or business contact databases.

3. Personal Information Collected When You Make Purchases (Our Third-Party Payment Processors)

• We do not collect or process credit or debit card data for your purchase of any Mozaik products or services.
• Apple and Google collect such data with respect to in-app purchases made through the Apple App or Google Play stores.
• In addition to Apple and Google, we may use unaffiliated third parties (e.g., Stripe, PayPal) to provide payment processing services that enable you to purchase products and services within our Services, including paying for your use of the Mozaik App (collectively referred to as “Payment Processor(s)”).
• It is important that you review the terms of use and privacy policy of any Payment Processors prior to using their services.
• Payment Processors will utilize your financial information (e.g., bank account numbers, credit card numbers) to process your payments of purchases.
• By utilizing our Services, you agree that you are bound by the applicable Payment Processor’s terms and policies regarding the protection, storage, or utilization of your financial information.
• We have no control over and are not responsible for any Payment Processor’s use of your Personal Information collected through such payment processing service.
• Any information that you provide to the applicable Payment Processor will be subject to that Payment Processor’s privacy policy, rather than our Privacy Policy.
• Our use of a particular Payment Processor is not an endorsement of that Payment Processor, and we make no representations as to how such processors utilize or safeguard your Personal Information.

4. How We Use or Share Your Personal Information

• “Third-Party Service Providers” means contractors and consultants we directly hire to help us provide Services, but excludes Payment Processors, Other Third-Party Sources, email marketing providers, and third-party hosting services companies.
• Our Third-Party Service Providers may, upon our instruction and authorization, use your Personal Information to:
  • Provide, on our behalf, the Mozaik App and our Services for your use.
  • Set up and administer your account when you become a User.
  • Manage your account and send administrative information to you (e.g., information regarding the Services, fees, security alerts, technical notices, confirmations, support messages, changes to terms, conditions, and policies).
  • Use your information to facilitate payment processing related to your use of the Services.
  • Complete and fulfill your purchases of our products or services.
  • Maintain our Services to you, including providing you with customer service or support (e.g., responding to your inquiries and fulfilling your requests).
  • Maintain log data utilizing your information to track your progress or activity during your use of the Services.
  • Send and receive SMS messages directly to or from your mobile device.
  • Store and edit videos you created.
  • Review and moderate video content you created, viewed, or interacted with, including those posted as Mozaik Movies, Mozaik Twists, or Mozaik Clones.
  • Analyze, improve, or enhance our Services to you.
  • Store mobile data locally on your device to provide access to the Services when using the Mozaik App without an internet connection.
  • Personalize your experience by presenting content, products, and offers tailored to you.
  • Use your geolocation to provide you with certain features of the Service and possibly recommendations for relevant content and services in your area.
  • Use and/or store your information from Third-Party Services or Devices that you connect to our Service.
  • Track your interactions through the Mozaik App.
  • Send informational communications related to your use of Mozaik products and services that you signed up for or purchased.
  • Send marketing communications about Mozaik products and services that may interest you, subject to your expressed preferences.
  • Request your participation in surveys and administer them to understand user engagement or for marketing purposes.
  • Serve Mozaik advertisements with third parties (e.g., Facebook), subject to your consent or notice and opportunity to opt-out.
  • Aggregate non-personally identifiable information from all Users to understand usage and share with third parties if useful for promoting our products and services.
  • Use data for internal analysis, audits, security, integrity, new products/services development, promotional campaign analysis, and business operations.
• Third-Party Service Providers are not permitted to share or use your Personal Information for purposes other than providing services to us to operate our Services.
• We reserve the right to use, retain, or disclose any information for legal and compliance reasons (e.g., crime prevention, fraud, responding to legal requests, protecting legal rights, emergency situations).
